Section 18 Subsection 2 of the Constitution states:
(2)    As from the coming into force of this Constitution, no court in
The Gambia shall be competent to impose a sentence of death for anyoffence unless the sentence is prescribed by law and the offence
involves violence, or the administration of any toxic substance,
resulting in the death of another person.”
The Constitution is saying that one must kill introduced in the National Assembly which must
eventually be submitted at a referendum another person before
one could be sentenced to death.
Now a bill is being and which aims to delete the
portion of Section 18 subsection 2 which makes it mandatory for a
person to engage in violence or use of toxic substances which results
in death before one could be sentenced to death.
This means that if this bill is passed once the death penalty is fixed
for any crime, such as drug offences, it would be carried out.
