The Managing Director of Royal Seven African Gaming Company, Mr. Sang Pierre Gomez, on Thursday, 19 March, 2009, continued his testimony in the case involving his company and a former employee, Mr. Baba Kanye, the plaintiff.
Mr. Gomez, giving his testimony before Magistrate Sainabou Wadda Ceesay of Kanifing Industrial Tribunal, said that employees who were laid off alongside Mr. Kanye were reinstated, but that Mr. Kanye refused to accept the job offer.

When asked by the defence counsel, Edward Gomez, whether he was aware that Mr. Kanye picked up another job after refusing his company’s offer, the defence witness responded that he was informed that the plaintiff had worked with another Casino.
The Defence counsel asked the witness whether he had made any payment to Mr. Kanye after he was laid off from the company and, if so, whether he’ll be able to recognise the relevant pay slip and the witness responded in the positive. The defence counsel produced a payment slip which was objected to by the plaintiff, who argued that he did not sign the document. The document was however admitted as an exhibit by the tribunal.
In continuing his testimony, Mr. Gomez told the tribunal that the plaintiff, Mr. Kanye, had previously taken his compensation claim to another tribunal which ruled that he was not entitled to such.
He further told the tribunal that he was not aware of any appeal made by Mr. Kanye to the higher court seeking for the overturning of the decision reached by the tribunal.
At this juncture, the defence counsel tendered documents relating to Mr. Kanye’s previous case at the tribunal. These documents were admitted as exhibits without any objection by the plaintiff.
The witness said Mr. Kanye’s previous suit was in late 2007.
In his cross examination, Mr. Kanye asked the witness to tell them what his (Gomez’s) position was when he (Kanye) was laid off.
In response, Mr. Gomez said he was just an employee then.
The case was adjourned to 2 April, for continuation of cross-examination.
